Wasn't the basic problem with DOMA the fact that it violates the Equal Protections Clause of the 14th Amendment? Although this is also a serious problem with the legislation. Bad idea, bad execution; the Federal Government has no legitimate business defining what is and isn't a marriage. That's for the States, should they choose to exercise that authority.

Tim, you make a good point. Frankly, why does government have a say at all in whom they issue marriage licenses?

This really should not be a government issue at all, despite the fact that I do have moral concerns regarding the misappropriation of the term and sacrament of marriage when used by gay couples.
